Your rights and responsibilities when using Caire

Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the Caire website, applications, and related services (collectively, the “Services”).
By creating an account, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
We may update these Terms from time to time. Material changes may be notified in-product, by email, or both. Continued use after the effective date of updated Terms constitutes acceptance.
Nature of the Service
Caire is an AI mental health service for wellness support. The Services may include:
- Conversational support using evidence-based frameworks (for example CBT, DBT, motivational interviewing, person-centred approaches)
- Wellness observations based on information you provide
- Coping techniques, psychoeducation, and self-help resources
- Text and voice interactions
The Services may be used individually or as part of a workplace wellbeing programme. Participants always sign up directly under Caire's terms, regardless of how they discovered the service.
Caire is not a healthcare provider. Use of the Services does not create a therapist-patient, doctor-patient, or other professional-client relationship.
Medical & Mental Health Disclaimer
The Services are not a substitute for professional medical advice, diagnosis, or treatment.
Caire is not intended to diagnose, treat, cure, or prevent any disease.
You acknowledge and agree that:
- No professional diagnosis: AI output is not equivalent to a diagnosis from a licensed clinician.
- No treatment replacement: AI-delivered support does not replace professional therapy, psychiatry, or medical care.
- AI limitations: Output may be inaccurate, incomplete, offensive, inappropriate, unsafe, or otherwise unsuitable for your context.
- No crisis reliance: You agree not to rely on the Services for crisis intervention, emergencies, or time-sensitive safety decisions.
- Emergency situations: If you are in crisis, at risk of self-harm, or believe someone may be in immediate danger, contact emergency services immediately (911 US, 999 UK), 988 (US), or local emergency responders.
Eligibility, Age Verification & Registration
18+ only: You must be at least 18 years old to use Caire. By using the Services, you represent and warrant you are 18 or older.
Age verification: We require age self-attestation and age-range collection at onboarding, and may use additional verification steps where reasonably necessary. If we reasonably believe an account is used by or for a minor, we may suspend or terminate access immediately.
Parental use policy: Parents/guardians may use their own account for themselves, but may not create, share, or operate accounts for minors and may not submit minor personal health information through the Services.
Account registration: You must provide accurate information and keep credentials confidential. You are responsible for activity under your account.
User Responsibilities & Assumption of Risk
By using the Services, you acknowledge and accept that:
- Your decisions are your own: You are solely responsible for actions and decisions based on any AI output.
- Voluntary use and risk assumption: Your use is voluntary and at your own risk.
- Independent verification: You will independently verify material health-related information with a licensed professional.
- No crisis reliance: You agree not to rely on Caire as your sole or primary resource in a crisis.
- Professional care: You agree to seek appropriate professional care for diagnosed or suspected mental health conditions.
Acceptable Use
You agree not to use the Services to:
- Violate law or regulation
- Harass, threaten, exploit, or harm any person
- Generate content promoting violence, self-harm, or illegal activity
- Bypass safety controls or reverse-engineer systems
- Use the Services on behalf of minors under 18
- Represent AI output as human professional advice
We may suspend, restrict, or terminate access for violations, abuse, safety risk, legal compliance needs, or suspected minor access.
Content, Data Protection & AI Processing
Your Input and AI Output: You retain rights in your input content. AI output may be non-unique and may be incorrect.
Training-data policy: By default, your conversation content is not used to train foundation AI models. We only use conversation content for training/fine-tuning if you explicitly opt in.
Third-party processors: We use infrastructure and service subprocessors to deliver the Services, including providers for authentication, hosting/storage, analytics, and, where applicable, AI/speech processing. See our Privacy Policy for details about how third-party processing is handled.
Data residency: Customer data is primarily stored in the United Kingdom. Some subprocessors may process data in the US, UK, or EU, subject to contractual and legal safeguards for cross-border transfers.
Retention: Active account data is retained while your account remains active. Deleted chats are retained up to 30 days. Following account deletion requests, account data is removed within 30 days, with backup/log purge completed on a rolling basis.
Limitation of Liability
To the maximum extent permitted by applicable law:
- Services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind.
- We disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and accuracy.
- We are not liable for decisions or harms arising from use of, or reliance on, AI output, including health and safety outcomes, missed emergencies, and failure to obtain professional care.
- We are not liable for indirect, incidental, consequential, exemplary, special, or punitive damages, or for lost profits, data, goodwill, or business interruption.
- Our aggregate liability for all claims in any 12-month period is limited to the greater of fees paid by you in that period or US$100.
Where law does not allow limitations or exclusions, liability is limited to the maximum extent legally permitted.
Indemnification
You agree to indemnify, defend, and hold harmless Caire and its affiliates, officers, directors, employees, agents, and licensors from claims, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use or misuse of the Services
- Your violation of these Terms or applicable law
- Your content, instructions, or reliance on AI output
- Claims brought by third parties related to your account activity
Intellectual Property
We and our licensors own all rights in the Services, including software, models, systems, branding, and content (excluding your input).
Feedback you submit may be used without restriction or compensation.
Suspension & Termination
By you: You may stop using the Services and delete your account at any time.
By us: We may suspend or terminate access for Terms violations, legal requirements, safety concerns, abuse, or if an account appears to be used by or for a minor.
Provisions that by nature survive termination (including liability limitations, indemnification, and dispute resolution) will survive.
Dispute Resolution, Governing Law & Venue
Informal resolution first: Before formal action, you agree to contact us and attempt good-faith informal resolution for at least 30 days.
Governing law: These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules, except where mandatory consumer protection law in your country of residence applies.
United States users, binding arbitration: If you reside in the United States, disputes arising out of or relating to these Terms or the Services will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under the AAA Consumer Arbitration Rules. The Federal Arbitration Act governs this arbitration agreement.
Arbitration carve-outs: Either party may bring qualifying claims in small claims court. Either party may seek injunctive or equitable relief in court for intellectual property misuse or urgent security abuse.
Class action and jury trial waiver: To the fullest extent permitted by law, disputes must be brought on an individual basis, not as a plaintiff or class member in any class, collective, consolidated, private-attorney-general, or representative action. You and Caire waive any right to a jury trial for arbitrable disputes.
UK and EU users: If you reside in the UK or EU, you may bring claims in the courts of your local jurisdiction, and mandatory local consumer rights remain unaffected.
All other users: If arbitration does not apply and you are outside the UK/EU, disputes must be brought exclusively in state or federal courts located in Denver, Colorado, and you consent to personal jurisdiction there.
General Provisions
These Terms and the Privacy Policy are the entire agreement regarding the Services.
If any provision is held unenforceable, the remainder remains in effect.
Our delay or failure to enforce any provision is not a waiver.
You may not assign rights under these Terms without our consent. We may assign these Terms without restriction.
